Court upholds rifle sales reporting requirement

WASHINGTON (AP) - A federal appeals court panel has unanimously upheld an Obama administration requirement that dealers in southwestern border states report when customers buy multiple high-powered rifles.

The firearms industry trade group, the National Shooting Sports Foundation, and two Arizona gun sellers argued that the administration overstepped its legal authority in the 2011 regulation, which applies to gun sellers in California, Arizona, New Mexico and Texas.

But the three-judge panel of the U.S. Circuit Court of Appeals for the District of Columbia said that the requirement was "unambiguously" authorized under the Gun Control Act of 1968.

The challengers argued that the requirement unlawfully creates a national firearms registry, but the court said because it applies to a small percentage of gun dealers, it doesn't come close to creating one.

The Big Read is a program of the National Endowment for the Arts designed to revitalize the role of literature in American culture. The Big Read brings together partners across the country to encourage citizens to read for pleasure and enlightenment.

Tom Green County Library is one of only 77 grantees chosen to participate in the Big Read this year. Participating communities receive high-quality, free-of-charge educational materials to supplement each title, including Reader’s, Teacher’s, and Audio Guides, which also are available for download on neabigread.org. The book selected by a committee in San Angelo is “Into the Beautiful North” by Luis Alberto Urrea. This will be a county wide program, sponsored by The Tom Green County Library and will include programs with Angelo State University, Saint Paul Presbyterian Church, SAISD and others. There will also be companion books for teens and children.

Events will be held throughout October 2013 that will relate to the book and certainly the highlight of events will be Luis Urrea’s three day visit to San Angelo. There will be free copies of the book and study guides for the public. The subject matter of “Into the Beautiful North” is very timely and people from both sides of the border will be touched by its insights, humor, and the truths that it reveals about crossing the border and venturing north. The book is expected to open up lively conversations about family, travel, immigration, strength and determination.

The kick-off event will be on Saturday, October 5 and book discussions will be hosted by local groups as well as the library. These groups can receive copies of the book and reading guides to help them in their discussions. Man held in abduction of ex-girlfriend

SAN ANGELO, Texas — A San Angelo man faces felony charges, accused of crashing his vehicle into a pickup driven by his ex-girlfriend and then forcibly taking her away and leaving her child in the pickup.

Nathan Kyle Burnett, 30, was in custody Wednesday with bail set at $130,000.

Witnesses told police they saw a man pull a woman from the crashed pickup by her hair, force her into his car and drive away, according to a San Angelo Police Department news release.

The crash was reported about 4:20 p.m. Friday.

Several unmarked police vehicles responded to an area north of Foster Communications Coliseum where the man was last seen, police said.

Burnett was found soon afterward and arrested on the north side of Paraiso Bar on Old Ballinger Highway and Covington Road on suspicion of aggravated kidnapping and endangering a child, police said.

Perla Martinez, the woman taken from the crash scene, was found unharmed in Burnett’s car. Police said Martinez’s child was left in her pickup at the crash site.

Burnett and Martinez were taken to the police station for questioning.

Items thought to have been stolen in a burglary earlier in the day were found in the trunk of Burnett’s car, police said.

In an interview with Burnett, police said they determined he had used a stolen debit card to withdraw $1,000 from a victim’s bank account after the burglary. More stolen property was found in a Dumpster behind Crockett National Bank.

A burglary of habitation charge against Burnett is pending, police Lt. Mike Hernandez said.

“This thing could have gone south,” he said Wednesday. “When officers found out what the call was, they hit the street.”

Burnett’s bail was set at $100,000 on the kidnapping charge and $30,000 on the child endangerment charge.

Aggravated kidnapping is a first-degree felony punishable by five years to life in prison and a fine up to $10,000.

Abandoning or endangering a child under circumstances that a reasonable person would believe would place the child in imminent danger of death, bodily injury or physical or mental impairment is a second-degree felony, punishable by two to 20 years in prison and a fine up to $10,000.

Laurens County man wants murder conviction overturned

A Laurens County youth who confessed to a slaying when he was 16 years old is now asking the Georgia Supreme Court to review his murder conviction and life sentence.

Demicio White contends that the evidence against him was insufficient to prove his guilt and that he was represented at trial by an incompetent lawyer in violation of his constitutional rights.

On the night of Nov. 13, 2006, Robert Derek Hazley II was shot once in the face with a .380-caliber pistol. After an investigation, police arrested White two days later and charged him with the crime, according to a case summary from the court.

Prosecutors contended that White had learned the night before that his girlfriend had walked to the store with another teen, whom White did not know. The state contended that he later shot Hazley, thinking he was the one who had been with his girlfriend.

On Nov. 15, 2006, investigators interviewed White three times over seven hours in which he gave different accounts of his actions and whereabouts. During the third interview, he confessed to the killing. His parents were not present.

In June 2007, a jury convicted him of felony murder and he was sentenced to life in prison.

White’s appeals lawyer now contends that the evidence was insufficient to find him guilty beyond a reasonable doubt, according to the case summary. And there was no physical evidence linking him to the crime, they maintain.

“The primary evidence relied upon by the state was an admission sandwiched between denials elicited from a 16-year-old child who was questioned several times while in the hands of law enforcement for seven hours without seeing his parents,” the attorney argues in briefs.

“He was told by his interviewers he had failed a polygraph test, that he was entitled to have his parents present but that it would not be a good idea, and that others were going to say he committed the crime.”

The trial court also erred in finding that his trial attorney was not constitutionally ineffective, according to the brief. His attorney made a number of mistakes, including his failure to file notice with the court within the time required that he would present evidence showing White had an alibi for the night of the crime.

White’s appeals attorney also argues that the trial attorney was also incompetent for failing to subpoena cellphone records, which would have proven White’s location away from the crime.

The state argues the evidence was sufficient to find White guilty of felony murder, but that because his trial attorney failed to present any argument or legal citation, the point is considered abandoned under court rules.

The state also argues that White’s trial attorney was competent and effective. Although White’s trial attorney did not testify at the hearing on White’s motion for a new trial, “there is strong evidence trial counsel made a strategic and calculated decision not to give notice of alibi, as there was no alibi defense.”

White “presented an identity defense during trial, i.e., that someone else shot the victim,” the state said in its brief.

White’s trial attorney laid the groundwork that at least two other individuals had motive and could have been the shooter.

Edinburg (2-5) would score four runs in the third inning to take a 4-3 lead on a Carlton Salters three-run home run which was the first of the season.

San Angelo tied the game at 4 in the seventh inning when Steve Rinaudo hit his first homerun of the season.

Moreland HR backs Grimm; Rangers top D-backs 9-5

ARLINGTON, Texas (AP) -- Justin Grimm joined the Texas rotation as a stopgap.

The rookie right-hander pitched more like an ace Thursday.

Mitch Moreland hit a two-run homer and Grimm took a shutout into the sixth inning to help the Rangers snap their first three-game losing streak of the season with a 9-5 interleague victory against the Arizona Diamondbacks on Thursday.

Grimm (5-3) allowed four hits through five innings while Texas cooled off Arizona starter Brandon McCarthy on the way to a 9-0 lead.

The AL rookie leader in wins and strikeouts was replaced after Arizona's three-run sixth, and trails only ace Yu Darvish in victories on the Texas staff.

The 24-year-old Grimm, who made his debut last year, came up from the minors in April when opening day starter Matt Harrison went on the disabled list with back trouble.

He figured to stick around awhile with Harrison out until at least August, and was the AL rookie of the month for April. He gave up eight hits and two earned runs with three strikeouts in his third straight May win after starting the month with all three of his losses.

''He's gotten better as far as confidence-wise, believing and knowing that belongs here,'' catcher A.J. Pierzynski said. ''It just a progression with young guys. He continues to get better. You can see it in his face. You can see it when he takes the mound in his mannerisms.''

McCarthy (2-4) had allowed one run in 25 innings when the Rangers scored six in a span of four outs in the second and third.

The outburst started when center fielder A.J. Pollock misplayed a line drive by Nelson Cruz into a double. Pierzynski brought Cruz home with a double and scored on a two-out single from Leonys Martin.

The Rangers went up 6-0 in the third on three straight run-scoring hits - a double from Adrian Beltre, a single by Cruz and a two-run homer from Moreland that hit near the top of the foul pole in right.

McCarthy lost for the first time since April 26 in his shortest outing of the season. He gave up nine hits and six runs in just 2 2-3 innings.

''I didn't have any life on my stuff,'' said McCarthy, whose ERA at Rangers Ballpark is 7.65 in four starts since he left Texas in 2009. ''It was a fight for me. A good lineup hits those pitches. It's not an easy lineup to get out.''

Grimm lost his shutout when he gave up four straight hits in the sixth, starting with a double from Paul Goldschmidt, who tied a career high with four hits. An error by Martin in center on a single by Miguel Montero led to an unearned run.

''It's just all about battling and competing against these guys,'' Grimm said. ''Be aggressive with them, but not overly aggressive obviously.''

The Rangers beat the Diamondbacks after they were swept in a doubleheader in Arizona on Monday and had the first of two games in Texas rained out Wednesday night.

Moreland was hit by a pitch on the shoulder by reliever Josh Collmenter the next time he came up after his 11th home run and scored on a two-run single from Elvis Andrus that made it 9-0.

''Honestly, I hadn't even thought about us losing three games,'' Moreland said. ''We're going to go out and play our style of ball. We got out of it for a couple of games, but came back out today and made it work and it was a good win for us.''

The Diamondbacks got within 9-5 in the seventh on RBI singles from Goldschmidt and Martin Prado off Texas reliever Michael Kirkman. Neal Cotts replaced Kirkman with two outs and struck out Montero with the tying run on deck.

Arizona had the tying run on deck again in the ninth when Robbie Ross got a game-ending double play from Cliff Pennington, who replaced Eric Chavez in the first inning after Chavez strained his right oblique on a swing.

''The guys came back,'' Arizona manager Kirk Gibson said.

Texas prospect Jurickson Profar had a career-high three hits a day after learning that his stay with the Rangers would be at least two weeks longer because second baseman Ian Kinsler's rib injury has been slow to heal.

Moreland and David Murphy, who hit his fifth homer, were among four Rangers with two hits.

Notes: Gibson said Chavez was on his way back to Arizona for an MRI. If Chavez is headed for the disabled list, the Diamondbacks might bring up Willie Bloomquist from a weeklong rehab assignment at Triple-A Reno. ... The Texas grounds crew stayed until 2 a.m. after a high winds from a thunderstorm prevented the crew from getting the tarp down before heavy rainfall. Both baselines were swamped and had to be rebuilt.

Special weather statement

It's going to be very hot today then very cold tonight. The National Weather Service at San Angelo says a cold front will move into west central Texas and the Concho Valley this evening and tomorrow morning. It will bring showers and thunderstorms, some of which could be severe with large hail. Temperatures will drop into the 40's tonight and might hit 50 for a high tomorrow. Also, gusty winds might cause areas of blowing dust, causing difficult driving conditions on east-west roads, including Interstates 10 and 20.

The Magic Valley Carnival kicks off today. The Carnival officially starts at 6 PM and continues through Sunday on the West side of the Paseo de Santa Angela grounds on Avenue D. The meetings will include a presentation from Gateway Planning Group, which was hired by the city council to craft a master plan for developing Lake Nasworthy for recreational, residential and commercial uses. Each of the meetings will be in the City Council chambers/South Meeting Room at the McNease Convention Center, 500 Rio Concho Drive. The first meeting is this morning from 8:30 to 10 and the other is tomorrow night from 6 to 7:30.

Car versus animal clinic

San Angelo Police were called to South Oakes Street early last Saturday morning for a hit and run crash involving the Angelo Animal Clinic. A witness said that a 2010 Chevrolet Camaro traveling east on West Avenue N at a high rate of speed crashed into the south side of the clinic. The driver reportedly exited the vehicle and ran northbound on Oakes. About a block away, a man flagged down a patrol car, claiming to be the victim of a crime. However, police concluded that 27-year-old Salvador Patlan of San Angelo, who appeared to be intoxicated, was actually the driver of the Camaro. Patlan was arrested after being taken to a hospital for treatment of injuries sustained in the crash, which caused major damage to the Animal Clinic.

Bomb scare

Businesses in and adjacent to The Commons Shopping Center at Sherwood Way and Arden Road were inaccessible for about 3½ hours Tuesday as law enforcement officials investigated a suspicious package left in the parking lot. It was a hard-shelled plastic container and a bomb-sniffing dog from Goodfellow Air Force Base and the Abilene Police Department's bomb squad, the closest such operation to San Angelo, were summoned. No explosives were found. Fire Marshal Ross Coleman said they hated having to disrupt those businesses, but--quote--"In the wake of recent events in Boston and West, Texas, it's a simple matter of protecting the public."
