Judge May Take the Stand In Warren Jeffs Trial

The judge on the witness stand? It might happen in the trial of polygamous religious group leader Warren Jeffs. A preliminary hearing at the Tom Green County Courthouse saw defense attorneys present a list of witnesses for the trial. One of them: 51st District Judge Barbara Walther. Jeffs' legal team objecting to what it says were remarks by Walther three years ago that some children might need to be removed from Jeffs' Zion Ranch. Prosecutors moved to quash the subpoena for Walther but the presiding judge, State District Judge John Hyde of Midland, said he won't rule until he's heard other witnesses. Jeff's trial begins next Monday.
